Prado Areas of Law: Civil Rights, Constitutional Law Plaintiff filed suit under 42 U.S.C. 1983, alleging claims arising out of injuries he sustained while he was detained at a facility operated by Nueces County and was under the care of the facility's medical professionals, Deborah Charette and Chelsea Johnson. The Fifth Circuit held that the district court did not err in concluding that plaintiff's claims against Charette and Johnson were barred by the statute of limitations. However, the district court erred in dismissing plaintiff's claims against the County because the amended complaint pleaded facts sufficient to support a municipal liability claim that was plausible on its face.
